According to police facts, around 4:20am on Saturday, July 10 Swindle was driving a grey Holden Colorado in an easterly direction on Henry Parkes Way, Parkes.
He was directed to stop by police for the purposes of an RBT approximately 100 metres west of the intersection of the Henry Parkes Way and Moulden Street.

When asked to produce his license, Swindle stated he did not have it on him and that he was still disqualified from driving.
Police checks revealed that Swindle was the holder of a disqualified class C P2 license and was disqualified from June 7 for six months.
Swindle submitted to a breath test which returned a positive result and was taken to Parkes Police Station where a breath analysis revealed that he had 0.059 grams of alcohol in 210 litres of breath.
Swindle was disqualified from driving for six months and placed on a conditional release order for driving while disqualified.
He was fined $600 for driving with a low range PCA, disqualified from driving for three months and given a 12 month interlock order.
