Copyright and the Internet ...

Just because you can, doesn’t mean you should!

Some people believe that if something is on the internet, it can be used freely by anyone – images can be saved, music downloaded and information copied, pasted and printed – the internet contains a wealth of resources; all there waiting for us to use.

Unfortunately, this isn’t the case: the internet is covered by copyright laws, just as are books, newspapers, magazines, photographs and music – anything written, captured or created is covered by the Copyright Act 1968 (http://www.austlii.edu.au/au/leg is/cth/consol_act/ca1968133/), regardless of where it ends up; the internet included. So, just because it is possible to obtain resources from the internet; doesn’t mean you should.

Copyright is automatic and doesn’t cost anything – once you write, capture or create something new: the end result is instantly covered by copyright (provided it is satisfactorily, original). The moment you create your work, it is protected by copyright, and usually lasts for about 70 years after your death. As the creator, only you can decide how your work may be used.

What does all this mean for the average Joe who finds it easier to “scrounge” from the internet than create something themselves? Well it means you must seek permission before saving, printing or downloading anything from the internet. Have a look on the website for a copyright notice – this will usually inform you of how the resource may be used.

If you can’t find a copyright notice don’t assume the resource isn’t covered by copyright – instead, email the website owner asking for permission to use the resource. Only use the resource after obtaining permission and always keep a copy of any permission obtained – it might save you a hefty fine later.

The reason for all this isn’t to make your life as hard as possible, but to protect the rights of the creator. A lot of blood, sweat and tears can go into creating so it’s only fair that the person who sheds the blood, sweat and tears receives the accolades. It’s all about giving credit where credit is due.

As a creator, I understand the importance of this; but for those who aren’t so creative, the concept can often be hard to grasp: why do they put it on the internet if they don’t want it to be used? Well, it could be for a thousand different reasons – because a business paid for an eye-catching website full of images as part of an advertising campaign; because a creator decided to sell their work via the internet; or simply because they wanted others to "see" their work. None of which include: because I wanted people to claim my work as theirs and use it without my permission.

If a person creates a fabulous garden statue and places it in their front yard for the viewing pleasure of passersby; is it acceptable to walk into their yard and take their statue. Even though the front gate may be open, we all know this is stealing. The same principle can be applied to the internet; just because it’s on display – doesn’t mean it’s yours to take.

The Australian Copyright Council (http://www.copyright.org.au) is a good resource for information on copyright and has easy-to-understand Information Sheets available – each sheet has the terms in which it can be used clearly stated – you may download and print one copy – if more copies are needed you must pay: http://www.shop.copyright.org.au/ .

Just remember: even though the internet is a plagiarist’s heaven, it is not a copyright-free-zone. When searching for resources add the phrase “royalty free” to your search engine query – some creators like to share.
